How Judge Jackson Beat Out Competition For High Court Nod

Law 360: "Attorney Curt Levey, president of the conservative-learning organization Committee for Justice, echoed that sentiment when he told Law360, 'There is and should be a much higher standard and level of scrutiny for confirming a Supreme Court justice than for a lower court nominee.'


'I'm not sure which way Sen. Graham will vote, but he's certainly entitled to change his mind after applying the higher standard,' Levey said.


Levey said he thinks Judge Jackson will get a few Republican votes, although not as many as Judge Childs or California Supreme Court Justice Leondra Kruger would have gotten.


'Biden decided it was more important to satisfy the left wing of his party than to choose a moderate, uncontroversial nominee that could attract a lot of Republican votes, and choose a nominee who would be more like Justice [Elena] Kagan than Justice [Sonia] Sotomayor — that is, someone who could influence her more conservative colleagues on the court,' Levey said."
