How data privacy laws should be enforced remains a key flashpoint in the debates over potential data privacy legislation. Some argue that data protection laws will need a private right of action to have the teeth necessary to prevent consumer harm. What might the consequences of allowing litigation in this area be? What are the implications of the recent storm of litigation in state courts and in the 9th Circuit? And will we see many lawsuits coming out of the COVID-19 pandemic? Our panelists will give an update on recent data privacy litigation and discuss broader trends and implications for privacy law.

Megan Brown is a partner at Wiley Rein LLP. Megan helps companies solve problems at the intersection of technological innovation and regulation. She helps clients manage cyber and privacy challenges, respond to government inquiries, and develop compliance strategies under the Federal Trade Commission Act, the Federal Communications Act, and state privacy, consumer protection and cybersecurity laws. She counsels companies on their national security obligations and global supply chain risks.

Jennifer Huddleston

Director of Technology & Innovation Policy, American Action Forum

Jennifer Huddleston is Director of Technology and Innovation Policy at the American Action Forum. Jennifer’s research focuses on the intersection of emerging technology and law. Her work has appeared in a wide range of outlets including USA Today, the Chicago Tribune, Business Insider, Slate, the New York Daily News, and The Hill. Jennifer has appeared on media outlets including CNBC and Fox Business to discuss to technology–related issues. She has also testified before Congress and state legislatures, and has been a regular panelist on issues such as transportation innovation, data privacy, and liability for content on online platforms including Section 230. Jennifer has a JD from the University of Alabama School of Law and a BA in political science from Wellesley College. Prior to joining AAF, Jennifer was a research fellow at the Mercatus Center.

Ashley Baker

Director of Public Policy, The Committee for Justice

Ashley Baker is the Director of Public Policy at the Committee for Justice. Her focus areas include the Supreme Court, technology and regulatory policy, and judicial nominations. Her writing has appeared in Fox News, USA Today, The Boston Globe, The Hill, Law360, RealClearPolitics, The American Spectator, and elsewhere. Ashley is an active member of the Federalist Society, where she serves as a member of the Regulatory Transparency Project's Cyber & Privacy working group. As a member of the Republication National Lawyers Association, she has served as a speaker on the Supreme Court, the federal judiciary, and other topics such as FISA reform. As an expert on the judicial nomination process, Ashley worked closely on the efforts to confirm Justices Neil Gorsuch and Brett Kavanaugh. Much of Ashley’s work is at the intersection of the intersection of the courts, regulation and technology. Ashley engages in policy analysis and outreach on legislation and regulations related to these issues.

In addition to appearing on One America News Network, Reel News on the Blaze TV Network and Huffington Post Live, she frequently speaks on panels in DC and at conferences around the United States. Before joining Americans for Tax Reform, she worked for Congressman Cliff Stearns’ (R-Fla.). She received her Master of Mass Communications with a Telecommunications Policy focus from the University of Florida and her B.A. from Virginia Tech.
