Senate Republicans have warned Democrats that should they try to filibuster Trump’s nominees, they could deploy the so-called “nuclear option” and move for a simple majority vote, effectively ending the judicial filibuster. Making a big move over a replacement for Ginsburg or Kennedy, G.O.P. operative Curt Levey told Politico, would be “a fight to the death,” whereas Democrats would likely be more accommodating with Scalia’s seat.
